The former personal attorney for Donald Trump has left her position as the US Attorney for New Jersey. This decision was prompted by a court battle that questioned her legal standing to occupy the role.

Acceptance of Resignation

The nation's top law enforcement official, Pam Bondi, announced the prosecutor's departure on the start of the week. She commented that the appeals court finding made it unworkable for the official to lead the department effectively.

"Do not interpret following the order as giving up," she wrote. "This battle will now reach across the country."

Her resignation was triggered by a US appeals court found that she had been serving in violation of the law as the top prosecutor. This ruling is expected to impact many criminal cases in the state.

The court declared that a temporary posting that did not receive confirmation by the US Senate ran afoul of the statute on vacant positions.

It was also stated that Habba will continue working within the Department of Justice as a top consultant. She will pursue additional appeals of the ruling, in the hope of achieving a different outcome.

Writing online, Bondi wrote that judges "must not override the appointment of prosecutors entrusted with performing the primary duty of the administration of prosecuting crime."
